Abstract/Summary

Explains the importance of providing children with the opportunity for their views to be directly heard in proceedings when their parents are divorcing. Discusses two methods of dispute resolution, namely negotiations between lawyers and mediation, and assesses which one works best for children wishing to be heard. Considers the advantages and criticisms of child-inclusive mediation, at what age children could be included in mediation, and issues relating to violent relationships.
