Abstract/Summary
The reactive approach of legal reform in response to technological advancements leaves victims of “online harms” without justice. This article proposes adoption of “failure to prevent” criminal and civil models in application to online harms (which produce online and offline effects), as a means of ensuring corporate accountability for failures to ensure consumers and members of the public are protected.
